These Terms & Conditions (“Terms”) form a binding agreement between you and GAMCO Investments (Pty) Ltd, a company duly incorporated under the laws of the Republic of South Africa with registration number 2018/096618/07, trading as Map My Future (“Map My Future”, “we”, “us”, “our”). They govern your access to and use of the Map My Future website, the assessment platform, and any related services we offer (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Service Description

Map My Future is an educational guidance platform for South African students. It uses your academic information and your responses to validated psychometric frameworks to surface course matches across South African universities and bursaries that may be relevant to your profile.

What the Service IS:

• An educational tool that surfaces course matches and bursary opportunities based on your inputs and validated psychometric frameworks
• A way to explore where your strengths, interests and academic profile may best align

What the Service IS NOT:

• A guarantee of admission to any university, faculty or course
• A guarantee of bursary or financial aid approval
• A guarantee of career success or earning potential
• A substitute for professional career counselling, psychological assessment, or financial advice

Course entry requirements, bursary availability and university information change regularly. Results are indicative only. You are responsible for verifying all university entry requirements, bursary eligibility criteria and application deadlines directly with the relevant institution before making any decision.

2. Eligibility and Parental Consent

The Service is intended for South African students, primarily those in Grades 10 to 12. You may use the Service if you are a learner or prospective higher-education applicant resident in South Africa.

If you are under the age of 18, you warrant that you have obtained the consent of your parent or legal guardian to use the Service and to make any payment under the Pro tier. By accepting these Terms and submitting personal information through the Service, you confirm that this consent has been obtained.

Parents or guardians who become aware that their child has used Map My Future without consent may contact our Information Officer (details in section 14) to request access to, correction of, or deletion of the child’s personal information.

3. User Obligations

You agree that you will:

• Provide accurate, complete and current information about yourself when creating an account and completing the assessment
• Keep your login credentials confidential and not share your account with any other person
• Use the Service only for lawful purposes and in accordance with these Terms
• Promptly update any information that becomes inaccurate or out of date

4. Intellectual Property

All content on the Service — including the matching algorithm, question set, course database, written and visual content, brand marks and the user interface — is the intellectual property of GAMCO Investments (Pty) Ltd, except where third-party content is clearly attributed. You may not copy, reproduce, distribute, publish, sell, sublicense or create derivative works of any part of the Service without our prior written consent.

Your assessment responses and personal information remain yours. By using the Service, you grant us a limited, non-exclusive licence to use that information for the purposes set out in the Privacy Policy.

5. Payment Terms

The Service offers a Free tier at no cost and a Pro tier at a one-time payment of R349, which provides permanent access to Pro features tied to your account.

Payments are processed by PayFast, a registered South African payment service provider. By initiating a Pro upgrade you agree to PayFast’s terms in addition to these Terms. We do not receive, see or store your card details.

5.1 Refund policy

Pro tier features (course matches, AI-generated insights, bursary matching and the personalised report) are digital goods that are unlocked and delivered immediately on payment. Once Pro features have been unlocked, the purchase is final and non-refundable, except where a refund is required by the Consumer Protection Act, 2008 (CPA) — for example, where the Service is materially defective, where it has been misrepresented, or where applicable law otherwise requires a refund. To request a refund on these grounds, contact support@mapmyfuture.co.za within 7 days of the transaction with the relevant details.

6. Prohibited Activities

You may not:

• Access the Service through any automated means (scraping, crawling, bots) without our prior written consent
• Reverse engineer, decompile or attempt to extract the source code or matching logic of the Service
• Interfere with or disrupt the Service, the servers or networks connected to it
• Use the Service to upload, store or transmit malware, viruses or any other malicious code
• Impersonate another person, or submit personal information that is not your own without authority
• Resell, white-label or commercially redistribute access to the Service

7. Third-Party Links and Services

The Service contains links to third-party websites and uses third-party service providers, including university application portals, bursary provider websites and the PayFast payment platform. We are not responsible for the content, terms, privacy practices or availability of any third-party site or service. Your use of any third-party site or service is at your own risk and subject to that third party’s own terms.

8. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties, express or implied, regarding the Service, including any warranty of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, or non-infringement.

Without limiting the foregoing:

• We do not warrant that the Service will be uninterrupted, error-free, or secure
• We do not warrant that the matching results, bursary suggestions or career insights are complete, accurate or applicable to your particular circumstances
• We do not warrant that the university entry requirements or bursary information held in our database are up to date at any given moment — you must verify these directly with the relevant institution

9. Limitation of Liability

To the fullest extent permitted by the Consumer Protection Act, 2008 and other applicable South African law, neither GAMCO Investments (Pty) Ltd nor its directors, employees, contractors or operators shall be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Service, including any decisions you make regarding university applications, course selection, subject choice or career direction.

Our aggregate liability to you in connection with the Service is limited, to the maximum extent permitted by law, to the amount you have paid to Map My Future in the 12 months preceding the event giving rise to the claim — that is, R349 for Pro tier users, or R0 for Free tier users.

Nothing in these Terms limits any liability that cannot lawfully be limited under South African law, including liability for gross negligence or wilful misconduct.

10. Indemnification

You agree to indemnify and hold harmless GAMCO Investments (Pty) Ltd, its directors, employees and contractors from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of any third party.

11. AI-Generated Content Disclaimer

Map My Future uses artificial intelligence systems to generate course matches, bursary suggestions and the personalised insights provided on the Pro tier. These outputs are produced by AI based on your inputs and the underlying frameworks, and they may contain errors, omissions or limitations. AI-generated content is not a substitute for advice from a qualified career counsellor, psychologist or university admissions officer.

You must independently verify all university entry requirements, course details, bursary eligibility criteria, application deadlines and career information before making any decision. By using the Service, you acknowledge that you understand the nature and limitations of AI-generated content.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms or the Service is subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

13. Changes to These Terms

We may amend these Terms from time to time. Where amendments are material, we will notify you by email or by a prominent notice on the Service before the amendments take effect. The “Last reviewed” date at the top of this page indicates when the Terms were last amended. Continued use of the Service after the effective date of any amendment constitutes acceptance of the amended Terms.
